City of Guelph Open Government Licence

This licence is based on version 1.0 of the Open Government Licence – Ontario, which was developed through public consultation and a collaborative effort by the provincial and federal government.

You are encouraged to use the Information that is available under this licence with only a few conditions. This License is between the City of Guelph as Information Provider and you. The following terms govern your use of the Information.

Using Information ​under this Agreement

  1. Use of any Information indicates your acceptance of the terms and conditions of this License.

  2. The Information Provider grants you a worldwide, royalty-free, perpetual, non-exclusive license to use the Information, including for commercial purposes, subject to the terms and conditions contained in this Agreement.

You are free to:

  1. Copy, modify, publish, translate, adapt, distribute or otherwise use this Information in any medium, mode or format for any lawful purpose.

You must, where you do any of the above:

  1. Acknowledge the source of the Information by including any attribution statement specified by the Information Provider and, where possible, provide a link to this licence. If the Information Provider does not provide a specific attribution statement, or if you are using Information from several information providers and multiple attributions are not practical for your product or application, you must use the following attribution statement:”Contains information provided by the City of Guelph under an open government license.

  2. The terms of this license are important and if you fail to comply with any of them the rights granted to you under this License will end automatically.

Exemptions

  1. This list does not cover the use of: Personal Information; Information or records that are not accessible pursuant to the Municipal Freedom of Information and Protection of Privacy Act of Ontario and the Personal Health Information Protection Act of Ontario; Third-party rights the Information Provider is not authorized to license, if any; The Information Provider’s logos, trademarks, slogans or crests or other official symbols; and Information subject to other intellectual property rights, including patents, trade-marks and official marks.

Non-Endorsement

  1. This Licence does not grant you any right to use the Information in a way that suggests any official status or that the Information Provider endorses you or your use of the Information.

No Warranty

  1. The Information is licensed ‘as is’ and the Information Provider excludes all representations, warranties, obligations and liabilities, whether express or implied, in relation to the Information to the maximum extent permitted by law.

  2. The Information Provider is not liable for any errors or omissions in the Information and will not, under any circumstances, be liable for any direct, indirect, special, incidental, consequential, or other loss, injury or damage caused by its use, or otherwise arising in connection with this license or the Information even if specifically advised of the possibility of such loss, injury or damage.

Governing Law

  1. This License is governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

  2. Legal Proceedings related to this licence may only be brought in the courts of Ontario.

Definitions

In this Agreement, the terms below have the following meanings:

  • ‘Information’ means information or data protected by copyright that is expressly made available under the terms of this license on or through the City of Guelph open data website or other open data sites of the Information Provider;

  • ‘Information Provider’ means the City of Guelph;

  • ‘License’ means this City of Guelph Open Government License;

  • ‘Personal Information’ has the meaning set out in section 2 of the Municipal Freedom of Information and Protection of Privacy Act of Ontario, RSO 1990, c M.-56;

  • ‘Personal Health Information’ has the meaning set out in section 4 of the Personal Health Information Protection Act 2004 of Ontario, S.O. 2004, c. 3, Sched. A;

  • ‘Record’ has the meaning set out in section 2 of the Municipal Freedom of Information and Protection of Privacy Act of Ontario, R.S.O 1990, c M.-56 and in section 2 of the Personal Health Information Protection Act 2004, of Ontario, S.O. 2004, c. 3, Sched. A; and

  • ‘you’ or ‘your’ means the natural or legal person, or body of persons corporate or incorporate, as applicable, acquiring rights under this license.

About this License

The City of Guelph wishes to use this License as a tool to enable the use and re-use of Information under a common open license.

This is version 1 of the Open Government License for the City of Guelph. The City of Guelph may, from time to time, issue new versions of the License. However, you may continue to use Information licensed under this version should you wish to do so. Notices of new versions of the License will be posted on the City of Guelph open data website. Your use of the Information will be governed by the terms of the License in force as of the date you accessed the Information.
